Dear Upstate Alchemy Customer,

 

We want to make you aware of an important change in federal law that could dramatically affect your ability to purchase many of the Upstate Alchemy products you use today.

 

What is happening?

 

In November 2025, Congress passed legislation to reopen and fund the federal government that significantly changed the federal definition of legal hemp.

 

Senator Mitch McConnell (R-Kentucky) helped secure the hemp language in the legislation. The stated intent was to close what he described as a loophole allowing unregulated intoxicating THC products to be sold under the federal definition of hemp.

 

Unfortunately, the language Congress adopted goes much further.

 

Unless Congress acts, beginning November 12, 2026, finished hemp products will be limited to just 0.4 milligrams of THC per entire container—not per serving.

 

Because full-spectrum hemp naturally contains trace amounts of THC, this extremely low threshold would also eliminate many traditional, non-intoxicating full-spectrum products—even when the amount of THC in each serving is far too small to produce an intoxicating effect.

 

What does this mean for Upstate Alchemy customers?

 

If the law takes effect as written, most Upstate Alchemy products would have to be discontinued or reformulated, including All Upstate Alchemy tinctures, All Upstate Alchemy gummies, and Most Upstate Alchemy topical products

 

This law was intended, in part, to address intoxicating hemp products. Unfortunately, the 0.4 mg-per-container limit also captures traditional full-spectrum products that consumers have legally purchased for years.

 

We support reasonable hemp regulation—including product testing, manufacturing standards, accurate labeling, protections for children, and age restrictions for intoxicating products. But there is an important difference between regulating products designed to be intoxicating and eliminating traditional, non-intoxicating full-spectrum hemp products.

 

Congress can still fix this—and you can help.

 

Bipartisan efforts are underway to delay or replace these restrictions, but no permanent solution has yet been enacted.  If access to full-spectrum hemp products is important to you, please contact your U.S. Representative and U.S. Senators and ask them to protect legitimate full-spectrum hemp products while establishing reasonable, science-based safeguards for intoxicating products.  You can use the links below to find your representative/senator.

You don't need to write a lengthy message. Feel free to copy and paste this:

 

"I am a consumer of legal full-spectrum hemp/CBD products. I am concerned that the new 0.4 mg-per-container federal limit will eliminate many non-intoxicating full-spectrum products. Please support legislation that protects consumer access to legitimate full-spectrum hemp/CBD products while establishing reasonable, science-based regulations for intoxicating hemp products."

 

Please specifically mention the 0.4 mg-per-container limit and the November 12, 2026 effective date. Personal messages explaining why access to these products matters to you can be especially helpful.

 

There is still time—but Congress needs to hear from consumers.

 

Until Congress passes and the President signs legislation changing the law, we must prepare for the November 12 deadline. We will continue monitoring developments in Washington and keep you informed.
